Unfair dismissal qualifying period - an update
Unfair dismissal qualifying period: The increase from one to two years may affect only new starters
On 6 April 2012 the qualifying period for unfair dismissal will increase from one year to two years.
Although the Department of Business, Innovation and Skills has not yet made a formal announcement, it has informed some leading employment bodies that, subject to approval from Parliament, the new two-year qualifying period will only apply to employees whose employment begins on or after 6 April 2012. Those who are already in employment before 6th April 2012 will retain the present one-year qualifying period.
The difference in the qualifying period is a point which is likely to be missed by employers. Employers will need to be careful about the correct qualifying period that applies.
This is one of the changes proposed by the government as part of reforming employment law and the employment tribunal system.
